Legal Terms and Conditions
ACKNOWLEDGEMENT and ACCEPTANCE of our terms of service
Momentum Tickets is a business unit of the Momentum Entertainment General Partnership.
We are professional ticket brokers who sell tickets for live events at market value,
not face value. Face value is the price you will see printed on your ticket; however,
this is a number not determined by actual market value. Market value is entirely
based upon supply and demand and is often higher or lower than the face value of
a ticket. All purchases from Momentum Tickets may be assessed a shipping charge,
handling charge and Ohio sales tax, if applicable (if the sale is entirely within
the State of Ohio).
By visiting, using or ordering from this website, you expressly agree to be bound
by the following terms and conditions and to adhere to these Terms and Conditions
and all applicable laws and regulations governing this website.
If you break these terms and conditions, The Momentum Entertainment / Momentum Tickets
General Partnership reserves the right to cancel your ticket order, prevent your
future use of this website and/or take appropriate legal action against you.
This agreement will be governed by the laws of the State of Ohio applicable to contracts
entered into and performed exclusively in that State. Any court of competent jurisdiction
sitting within Cuyahoga County, Ohio, will be the exclusive jurisdiction and venue
for any disputes arising out of or relating to this Agreement. You hereby waive
any argument that any such court does not have jurisdiction over any dispute or
that the venue in any such court is not appropriate or convenient.
ORDERS
All sales are final. Tickets for live events are not replaceable; therefore, there
are no refunds, exchanges or order cancellations. If your event is postponed, the
tickets will be honored for the rescheduled date. If your event is cancelled, you
will receive a full refund of your purchase, excluding shipping costs. It is your
responsibility to keep your tickets in a safe place, as we cannot guarantee the
ability to re-print or re-send a lost ticket, and we will not refund a lost ticket.
Momentum Tickets will send you a ticket holder envelope with every purchase and
it is highly recommended that you secure your tickets in this holder. Sunlight and
weather conditions are potentially damaging to a paper ticket.
Occasionally, the tickets you have purchased may no longer be available by the time
your order is fulfilled. If equivalent or better seats are available at the same
price, a Momentum Tickets representative will contact you and offer this alternative.
If you do not wish to do this, or if we are unable to find equivalent or better
tickets for you, the order will be canceled and you will be refunded. Momentum Tickets
will NEVER charge you until we can guarantee ticket availability. This is an issue
we take very seriously, and it ensures a quality relationship with our customers.
CREDIT CARD USE
In order to deter fraud Momentum Entertainment / Momentum Tickets may, at its discretion,
request that the billing address and shipping address be the same when processing
credit card orders.
PERMITTED USE:
You agree that you are only authorized to visit, view and to retain a copy of pages
of the Momentum Tickets website for your own personal use. You may not duplicate,
download, publish, modify or otherwise distribute the material on this site for
any purpose other than to review event and promotional information, for personal
use, or to purchase tickets or merchandise, unless otherwise specifically authorized
by Momentum Tickets to do so.
INDEMNITY:
You agree to indemnify and hold harmless us and our subsidiaries, affiliates, and
employees, from any claim or demand, including attorneys' fees, made by you and/or
any third party(s) due to or arising out of your use of this website, breach of
this Agreement or the documents it incorporates by reference, your violation of
any law or the rights of a third party, or any issue that may occur or arise at
any venue to which tickets were purchased.
